Sometimes insurance companies will refuse to defend its policyholder, other named insured, or additional insured. We examine the policy language of the insuring agreement looking for coverage and scrutinize any exclusion that the insurance company may be relying upon to deny coverage. The duty to defend is broader than the duty to indemnify, so an insured may be able to tender the defense to the insurance company and obtain a defense of the case and appointment of an attorney, under a reservation of rights, while the coverage dispute is litigated and a court decides whether the insurance policy covers the claim. We have successfully represented individuals, corporations and other entities when their insurance companies decline to defend or indemnify them for claims brought by others as well as in situations in which our clients bring claims against third parties for accidents or events and insurance coverage is denied.
